Haddish’s birthday post comes before she is reportedly due in court in connection to her arrest for allegedly falling asleep behind the wheel of a car on Nov. 24.

PEOPLE confirmed that Haddish faced a DUI charge after being arrested by the Beverly Hills Police Department (BHPD) at the time. Haddish, who was arrested after authorities were notified about a woman behind the wheel of a vehicle that had stopped but was still running on Beverly Drive, was released that same day.

Following the arrest, she performed her stand-up show at the Laugh Factory in Long Beach, California, where she addressed the incident in audio obtained by TMZ

Recorded by an audience member at the show, Haddish is heard in the audio being asked what happened “last night,” to which she responds, “You tell me.”

“I had prayed to God to send me a man with a job, career, preferably in a uniform, and I answered my prayers,” she added, per the recording.
