"The Supreme Court, in this decision, I think, somewhat naively accepted the government's argument that it singled out TikTok for reasons totally separate from the speech on that platform," Berry says. "I would say that people have a right not just to post somewhere, but to post and collaborate with the platform they want to," the constitutional expert says. "I think once you start going down that road of allowing the government to pick certain speech platforms to shut down, it becomes pretty dangerous, and you run the risk of the government picking and choosing winners to try to tilt the free speech balance, tilt the marketplace of ideas."
