WASHINGTON — This week's climate change summit features lots of talk from different nations about their goals for reducing carbon emissions. But in the weird world of national climate pledges, numbers often aren’t quite what they seem. Sometimes a 55% reduction is about equal to 50% to 52%. Sometimes it’s even less. Sometimes it’s way more. As part of the Paris climate agreement process, each nation picks its own national goals for how much greenhouse gas should be cut by 2030 and — crucially — what baseline year it starts counting from for those cuts. That makes it difficult to compare countries’ emissions-cutting pledges to see who is promising more. US AND EU GOALS Both the United States and the European Union are offering similar-sounding pledges of cutting around half their emissions by 2030. But depending on what year you start from, each can sound significantly deeper than the other. The European Union goal, newly approved by the union’s parliament, is 55% below 1990 levels. The new U.S. goal announced Thursday by President Joe Biden is 50% to 52% below 2005 levels. If you convert the European goal to the American-preferred 2005 baseline, the two are the same. The European Union goal translates to 51% below 2005 levels, which is on par with the U.S. goal, said former Obama White House environmental aide Kate Larsen, a director at the private research Rhodium Group. But if you compare them using Europe's preferred 1990 as the baseline, the 50% minimum U.S. cut is only 41%, far shy of the 55% EU goal, according to Larsen’s calculations. If you compare the numbers to 2019, the last pre-pandemic year, the U.S. goal looks more ambitious than Europe's. The minimum the United States would be cutting is about 40% from today’s level and the EU only 35%, said Niklas Hohne, a climate scientist who helps run the Climate Action Tracker, which monitors world emission pledges. WHY DIFFERENT BASELINES? The idea behind different baselines goes back to a logjam that bogged down climate talks in 2009. Developed countries that already spewed lots of carbon pollution wanted poorer nations that were counting on fossil fuels for economic development to forgo the dirtier fuels, said John Podesta, who was then-President Barack Obama’s climate czar. So a solution was struck for the 2015 Paris agreement that allowed nations to voluntarily choose their own goals tailored to each country. Those nationally designed goals also included countries choosing their own baseline years. So countries tend to choose years in which they peaked or near peaked on carbon emissions. For example, Europe, which took early action after the 1997 Kyoto Protocol, chose to keep that treaty’s 1990 baseline because it factored in early cuts. This way, Europe gets credit for acting early. DOES IT MATTER? Many developed nations' goals pretty much even out, said Nigel Purvis, who was a U.S. State Department climate negotiator for the George W. Bush and Bill Clinton administrations. “At 50%, they’re all doing a lot,” Purvis said. “The baselines are becoming less important.” HIGHER GOALS Some nations are shooting higher. University of Maryland global sustainability professor Nate Hultman pointed to Denmark, which he said did the math to see how much emissions cutting was feasible for the future and found it to be 65% below 1990 levels. Denmark then purposely set a tougher goal, 70%, counting on unforeseen changes in technology that often happen. Climate Action Tracker’s Hohne said that despite the White House’s claims, the U.S. target is not enough to keep warming to no more than 1.5 degrees Celsius since pre-industrial times, the tougher Paris agreement target. The entire world must cut its emissions in half compared to 2019, Hohne said. But Biden's new U.S. target only translates to about 40% from 2019 levels. “If you take that comparison, then it doesn’t work,’’ Hohne told The Associated Press on Thursday. NOT JUST CARBON DIOXIDE Like other nations, the U.S. goal includes methane and hydrofluorocarbon gases that trap more heat but don’t last as long as carbon dioxide. Including those in the goals allows the United States to pick low-hanging fruit to better reach its goal, Larsen said. Russian President Vladimir Putin emphasized how slashing methane pollution quickly can get the world nearly halfway to its 1.5 degree Celsius goal. Reducing methane and HFCs gets results more quickly than cutting carbon dioxide, so cutting them “can buy us a lot of time,” Larsen said. HOW TO REACH US GOAL Most of the U.S. emissions reductions — about 70% — will likely come from the power sector, Hultman said. WASHINGTON — On one side of an upcoming Supreme Court case over a proposed natural gas pipeline in New Jersey are two lawyers with more than 250 arguments between them. On the other is Jeremy Feigenbaum, a lawyer for New Jersey who will be making his first Supreme Court appearance. It may be the greatest numerical mismatch in the history of the high court — a David argues with Goliaths story (although this David comes with millions of dollars a year in earnings potential). Justice Department lawyer Edwin Kneedler will be making his 148th argument. Kneedler, 75, had around 30 Supreme Court arguments under his belt by the time Feigenbaum, 32, was born. Paul Clement, 54, the former top Supreme Court lawyer for the Bush administration, will be arguing his 106th case. They are asking the Supreme Court to rule that private gas companies' use of the federal government's power of eminent domain to acquire property extends to parcels owned by a state. Feigenbaum, a native of New Jersey and the State Solicitor, persuaded a three-judge appellate panel to rule that states could not be compelled to give up their land. At issue is a roughly 120-mile pipeline that would run from northeastern Pennsylvania to central New Jersey. Although it's his first time arguing, Feigenbaum is familiar to the court. He worked for a year as a law clerk to Justice Elena Kagan in 2015-16. Co-workers from that year described him as an outstanding lawyer whose age belies his legal wisdom. “Jeremy has sort of risen as quickly as one possibly can in the legal bar. You can't work with Jeremy and not recognize that he is exceptionally talented. ... He's one of the most creative and persuasive advocates I know, both in writing and orally. I think that's how he became one of the youngest state solicitors in the country,” said Yaira Dubin, a former Kagan law clerk who first met Feigenbaum at Harvard Law School. Thomas Fu shared an office with Feigenbaum at the Supreme Court, where they talked about high court cases virtually nonstop for a year. “I think Jeremy will be right up with them in terms of quality,” Fu said. Clement filed the Supreme Court appeal that the justices are hearing, via telephone because of the coronavirus pandemic. He and Feigenbaum overlapped briefly at the Kirkland and Ellis law firm. “Jeremy is a terrific lawyer, and I was happy to play a small part in getting him his first Supreme Court argument,” Clement said in an email. ___ On rare occasions, determining who will argue a case can come down to flipping a coin, or fishing a name out of a bowl. That's how the court's clerk resolved an impasse over who would represent the position of 17 Native American tribes Monday in a case about coronavirus relief money. Sixteen tribes were being represented by lawyer Riyaz Kanji, a former Supreme Court law clerk who last year won a major Indian Country case before the court. The other choice was Jeffrey S. Rasmussen, who represents the Ute Indian Tribe and would be making his first argument. Each side wanted its lawyer to argue. Rasmussen asked that each group get equal time. The court's answer: no. Last Friday, the court gave the parties two final hours to work things out themselves. They failed. So with less than three days until argument, the court's clerk got the parties on the phone. He told them he would put the name of each tribe on a slip of paper, put the slips in a bowl and pull one out. The lawyer that represented that tribe would argue. WASHINGTON — A Pentagon panel is recommending that decisions to prosecute service members for sexual assault be made by independent authorities, not commanders, in what would be a major reversal of military practice and a change long sought by Congress members, The Associated Press has learned. The recommendation by an independent review commission created by Defence Secretary Lloyd Austin goes against decades of vehement Pentagon arguments to keep cases within the chain of command. It was among a number of initial recommendations delivered to Austin on Thursday, according to two senior defence officials. Austin expects to seek input from military service leaders before making any final decision, said the officials, who spoke on condition of anonymity to discuss internal reports not yet made public. But combating sexual assault in the military is a top priority for Austin, and the fact that this recommendation was made so directly and quickly suggests it will carry a lot of weight. The proposed changes outlined in the report represent Austin's effort to leave his mark on a problem that has long plagued the department, triggered widespread congressional condemnation and frustrated military leaders struggling to find prevention, treatment and prosecution efforts that work. The review panel said that for certain special victims crimes, designated independent judge advocates reporting to a civilian-led office of the Chief Special Victim Prosecutor should decide two key legal questions: whether to charge someone and, ultimately, if that charge should go to a court martial, the officials said. The crimes would include sexual assault, sexual harassment and, potentially, certain hate crimes. According to the officials, that recommendation would affect a small fraction of the wide range of military discipline cases that commanders regularly handle. The panel also is recommending that sexual harassment claims be investigated outside the chain of command, and that if a charge is substantiated, the military should immediately begin the process of discharging that person from the force while other legal proceedings continue. The officials said a driving part of the panel's deliberations was the belief that many service members have lost faith in the system and that these changes would help restore that faith. Eventually, they said, it could lead to increased reporting by victims of sexual assaults. The changes would require an increase in funding and personnel, but it is not yet clear how much. Removing legal decisions from the chain of command, however, won't eliminate the role of a commander in addressing sexual misconduct, the officials said. Unit leaders will still be responsible to setting a proper command climate and still must play a role in preventing and addressing sexual assault, harassment and other problems with their service members. Reports of sexual assaults have steadily gone up since 2006, according to department reports, including a 13% jump in 2018 and a 3% increase in 2019. The 2020 data is not yet available. There have been a number of changes in the Military Code of Justice over the last decade to add more civilian oversight to the military's prosecution of sexual assault cases and to beef up assistance for victims. But, lawmakers, such as Sen. Kirsten Gillibrand, have long demanded a more concrete shift, arguing that commanding officers should be stripped of the authority to decide whether serious crimes go to trial. Those commanders, Gillibrand and other argue, are often reluctant to pursue charges against their troops, and overrule recommendations for courts martial or reduce the charges. And they say that victims consistently say they are reluctant to file complaints because they don't believe they'll get support from their chain of command since often their attacker is a senior military member. Military leaders have persistently fought such a change, saying it would erode the chain of command. Every two years, the Defence Department conducts an anonymous survey that is released along with the annual report on sexual assaults. The most recent survey, done in 2018, found that more than 20,000 service members said they experienced some type of sexual assault, but only a third of those filed a formal report. The survey number was about 37% higher than the previous one two years earlier, and it fueled frustration within the department and outrage on Capitol Hill.
