Fox News Reporter Ordered to Appear at James Holmes Hearing (Report)

A Fox News reporter was ordered on Friday to appear at a hearing in the case against alleged Colorado movie theater shooter James Holmes, the Denver Post reported.

Judge William Sylvester signed off on a subpoena of New York-based Fox News reporter Jana Winter, compelling her to appear at a Feb. 4 hearing, at which Holmes' attorneys are expected to question her about her sources and aske her to turn over her notes from a story she wrote for FoxNews.com, the Post said.

In July, Winter was reporting from Aurora, Colo. on the mass shooting in a late-night screening of "The Dark Knight Rises" that left 12 dead and dozens wounded. She published a story about a package Holmes sent to his psychiatrist Dr. Lynne Fenton at the University of Colorado.

"Inside the package was a notebook full of details about how he was going to kill people," an unnamed law enforcement source told the FoxNews.com reporter. "There were drawings of what he was going to do in it -- drawings and illustrations of the massacre."

Holmes' lawyers contend that disclosing information about the notebook violated a gag order in the case.

"Identifying the law enforcement sources who leaked this information to the media is an issue of serious and material importance to the case," Holmes' attorneys wrote this week in a motion seeking the judge's order for Winter to appear.

There was no immediate response from Fox or Winter on the judge's order.

Earlier this week, the widow of one of the victims killed in the shooting filed suit against Fenton and her employer, the University of Colorado, Denver, alleging that the psychiatrist knew Holmes was dangerous and could have taken steps to protect the public, the Los Angeles Times reported.
